Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Neurture LLC ("Neurture," "we," "us," or "our"). By downloading, accessing, or using Neurture, you agree to these Terms. If you do not agree, do not use Neurture.

Our Privacy Policy explains how information is handled when you use Neurture.

1. What These Terms Cover

These Terms of Service govern your access to and use of Neurture, including the Neurture mobile app, the Neurture website, account features, billing and subscription features, gifts, access-code redemption, partner portals, support, deletion services, and related services that link to these Terms.

Neurture is a consumer-directed self-help service for habit change, cravings, urges, journaling, check-ins, assessments, reminders, meditations, breathwork, courses, coping plans, premium access, access-code redemption, and gift access.

Additional terms may apply to specific purchases, app-store transactions, gifts, partner programs, or third-party services. If those additional terms conflict with these Terms, the more specific terms control for that feature.

2. Not Medical, Therapy, Crisis, or Emergency Care

Neurture provides educational, self-guided, and evidence-informed tools. Neurture is not a medical device, medical provider, therapy service, crisis service, emergency service, detox service, or substitute for professional medical, psychiatric, psychological, addiction-treatment, legal, or other professional advice.

Neurture does not diagnose, treat, prevent, or cure any disease, disorder, addiction, mental-health condition, substance-use disorder, or other health condition. Using Neurture does not create a clinician-patient, therapist-client, counselor-client, sponsor-sponsee, or similar professional relationship with Neurture or anyone associated with Neurture.

The app may include crisis resources, helpline links, treatment-search resources, therapy-search resources, or other third-party resources. These resources are provided for convenience and may not be complete, available, accurate, or appropriate for your situation.

If you may hurt yourself or someone else, are in danger, are experiencing a medical emergency, are at risk of severe withdrawal, overdose, or acute instability, or need immediate help, call emergency services or a local crisis line right away. In the United States, call or text 988 for the Suicide & Crisis Lifeline and call 911 for emergencies.

3. Eligibility

You must be at least 13 years old to use Neurture. If you are under the age of majority where you live, you may use Neurture only with permission and supervision from a parent or legal guardian who agrees to these Terms.

Neurture is not directed to children under 13. Do not use Neurture if applicable law prohibits you from using the service.

4. Accounts and Security

Some features may require an account, sign-in with email, Apple, or Google, or another authentication method. You are responsible for the accuracy of information you provide and for keeping your account credentials, devices, and local backups secure.

You are responsible for activity under your account unless the activity results from our failure to use reasonable security measures. Tell us promptly if you believe your account has been compromised.

You may request account deletion through the app or by contacting support. Deleting your account does not automatically cancel an app-store subscription, website purchase, or other billing arrangement. You must cancel billing through the store, payment provider, or billing flow that manages that purchase.

5. Your License to Use Neurture

Subject to these Terms, Neurture grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use Neurture for your own personal, non-commercial use.

Apps are licensed, not sold. We and our licensors reserve all rights not expressly granted in these Terms.

  • You may not copy, modify, adapt, translate, sell, rent, lease, sublicense, distribute, or create derivative works from Neurture except as allowed by law or by these Terms.
  • You may not reverse engineer, decompile, disassemble, attempt to derive source code from, or bypass technical protections in Neurture except to the extent applicable law prohibits that restriction.
  • You may not interfere with, disrupt, overload, scrape, crawl, probe, scan, test, or access Neurture in a way that harms the service, other users, our systems, or third-party systems.
  • You may not use Neurture to break the law, violate another person's rights, compromise security, bypass billing, commit fraud, or abuse access-code, gift, promotion, referral, or partner systems.

6. Your Content, Feedback, and Conduct

You may create or store content in Neurture, such as journal entries, check-ins, urge logs, assessment responses, plans, custom text, support-team entries, gift messages, feedback, or other information. As between you and Neurture, you keep the rights you have in your content.

Much of the app's self-help content is designed to stay primarily on your device during ordinary use, as described in the Privacy Policy. When content leaves your device because you submit it, share it, export it, include it in feedback or support, use account or billing features, claim gifts, redeem access, or use website services, you give Neurture a limited license to host, process, transmit, display, store, and use that content as needed to operate, secure, support, improve, and enforce Neurture.

If you send us feedback, suggestions, ideas, bug reports, or other comments, we may use them without restriction or compensation to you.

Neurture does not currently operate a public social feed or anonymous forum. If any feature allows content to be visible or accessible to another person, you must not submit objectionable content or misuse that feature.

  • Do not submit content that is unlawful, fraudulent, deceptive, defamatory, harassing, threatening, abusive, hateful, exploitative, sexually explicit, invasive of privacy, infringing, or otherwise harmful.
  • Do not submit content that facilitates child exploitation or abuse, self-harm instructions, violence, illegal activity, non-consensual intimate content, impersonation, scams, or medical misinformation that could cause harm.
  • Do not submit another person's sensitive personal, health, contact, or financial information unless you have a lawful basis and their permission to do so.
  • We may review, remove, restrict, report, or preserve content, accounts, access codes, or partner access when we reasonably believe it violates these Terms, creates risk, or is required by law.
  • If Neurture offers AI-assisted or automated content features, those features are for general self-help support only. Do not rely on them for diagnosis, treatment, crisis response, emergency decisions, or professional advice. Report harmful or offensive AI-generated content to support@neurtureapp.com.

7. Payments, Subscriptions, Gifts, and Access Codes

Some features require payment, a subscription, a gift, a promotion, a partner entitlement, or an access code. Prices, subscription periods, trial details, renewal terms, taxes, and included features are shown at or before purchase or redemption where applicable.

In-app purchases and subscriptions made through the Apple App Store or Google Play are billed by the applicable app store and are subject to that store's payment, renewal, cancellation, and refund rules. Auto-renewing subscriptions renew until canceled. You can manage or cancel app-store subscriptions through your Apple App Store or Google Play account settings.

Website purchases, partner billing, credit packs, and gifts may be processed by Stripe or another payment provider. Those transactions are subject to the terms shown at checkout and the payment provider's terms.

Gift access, promotional access, partner access, access codes, claim links, and redemption codes are not cash, stored value, or gift cards unless expressly stated. They may be limited by duration, eligibility, quantity, sponsor, issuer, program, campaign, geography, fraud controls, or expiration rules. They may not be sold, transferred, or exchanged for cash unless we expressly allow it.

We may refuse, revoke, expire, or correct access if a purchase, subscription, gift, code, claim, redemption, entitlement, or referral appears mistaken, fraudulent, abusive, unauthorized, chargeback-related, or contrary to these Terms.

8. Partner, Sponsor, and Organization Use

Organizations, clinicians, coaches, treatment centers, employers, universities, professional programs, sponsors, affiliates, or other partners may receive access to partner portals, credit packs, redemption links, access-code tools, or related services.

If you use Neurture for an organization, you represent that you are authorized to do so and that the organization accepts these Terms. Organization access is for distributing eligible access, viewing allowed operational information, and managing the features provided to that organization.

Unless a separate written agreement says otherwise, partner and sponsor features are not an electronic health record, provider-facing patient-management system, emergency-monitoring system, crisis-response workflow, clinical decision-support tool, or HIPAA business associate service.

  • Do not enter patient charts, diagnosis details, treatment notes, psychotherapy notes, protected health information, employee medical information, or other unnecessary sensitive information into partner portals or access-management tools.
  • Do not promise users that Neurture will replace professional care, crisis services, detox, medication, treatment, supervision, or emergency response.
  • Do not sell, publish, or share access codes, QR codes, claim links, or redemption links outside the approved audience for that program.
  • Organizations are responsible for their own legal, employment, benefits, healthcare, advertising, consent, and privacy obligations.

9. Third-Party Services, Resources, and Links

Neurture may integrate with, link to, or rely on third-party services, including Apple, Google, RevenueCat, Stripe, Supabase, PostHog, Sentry, Airbridge, Brevo, SendGrid, app stores, payment providers, email providers, analytics providers, attribution providers, music services, crisis resources, provider directories, treatment resources, and external websites.

Third-party services are governed by their own terms and privacy policies. We do not control third-party services and are not responsible for their content, availability, accuracy, security, policies, fees, or practices.

You are responsible for complying with applicable third-party terms when using Neurture, including app-store terms, device terms, wireless data terms, payment-provider terms, and external-service terms.

10. Privacy and Local Data

Your use of Neurture is also governed by our Privacy Policy at https://neurtureapp.com/privacy-policy. The Privacy Policy describes what information is stored primarily on your device, what information may leave your device, the service providers we use, and your choices.

You are responsible for deciding what you enter into Neurture and what you export, share, email, upload, or save outside the app. Exported files, shared reports, screenshots, device backups, cloud backups, and files sent through your device share sheet may be handled by third parties or by your device settings.

No transmission or storage system is perfectly secure. Use caution when recording, exporting, or sharing sensitive recovery, mental-health, craving, habit, or personal information.

11. Neurture Content and Intellectual Property

Neurture, including the app, website, text, courses, meditations, breathwork, exercises, check-ins, assessments, plans, designs, software, graphics, logos, trademarks, service marks, and other content, is owned by Neurture or its licensors and is protected by intellectual-property and other laws.

You may use Neurture content only as part of your permitted use of the service. You may not reproduce, publish, train models on, redistribute, sell, or commercially exploit Neurture content without our prior written permission.

12. Maintenance, Support, and Service Changes

We may update, modify, suspend, limit, remove, discontinue, or change Neurture or any feature at any time, subject to applicable law and any specific purchase terms that apply.

We are responsible for maintenance and support for Neurture as described in these Terms or required by applicable law. Apple and Google have no obligation to provide maintenance or support for Neurture.

The app, app stores, operating systems, third-party SDKs, and related services may require updates for security, compatibility, bug fixes, or new functionality. Some features may not work without the latest version of the app, a supported device, an internet connection, an active account, or an active entitlement.

13. Disclaimers

To the maximum extent permitted by law, Neurture is provided as is and as available, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, availability, and non-infringement.

We do not guarantee that Neurture will be uninterrupted, error-free, secure, current, complete, or effective for your particular goals. We do not guarantee any health, recovery, sobriety, behavior-change, craving-reduction, treatment, clinical, employment, educational, financial, or other outcome.

Some jurisdictions do not allow certain disclaimers, so some of the disclaimers above may not apply to you. Nothing in these Terms limits rights you have under laws that cannot be waived.

14. Limitation of Liability

To the maximum extent permitted by law, Neurture and its owners, officers, employees, contractors, advisors, licensors, partners, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or similar damages, or for loss of profits, revenue, goodwill, data, content, access, business, or opportunity, arising out of or related to Neurture or these Terms.

To the maximum extent permitted by law, Neurture's total liability for any claim arising out of or related to Neurture or these Terms will be limited to the greater of the amount you paid directly to Neurture for the service giving rise to the claim during the 12 months before the claim arose or 100 US dollars.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, or consumer rights that cannot be waived where such exclusions are prohibited.

15. Termination

You may stop using Neurture at any time. We may suspend or terminate your access to Neurture if we reasonably believe you violated these Terms, created risk, misused the service, engaged in fraud or abuse, violated law, or if we discontinue the service or a feature.

After termination, sections that by their nature should survive will survive, including provisions about ownership, user content licenses already granted, payments owed, disclaimers, limitation of liability, dispute terms, app-store terms, and enforcement.

16. Apple App Store Terms

This section applies when you download or use Neurture through Apple platforms. These Terms are between you and Neurture LLC, not Apple. Neurture, not Apple, is solely responsible for Neurture and its content.

Your license to use Neurture on Apple-branded products is limited to a non-transferable license to use Neurture on Apple-branded products that you own or control and as permitted by the Apple Media Services Terms and Conditions, including applicable Family Sharing, volume purchase, or similar usage rules.

Neurture is responsible for maintenance and support for Neurture as required by these Terms or applicable law. Apple has no obligation to provide maintenance or support for Neurture.

To the extent any warranty is not effectively disclaimed, Neurture is responsible for that warranty. If Neurture fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, for Neurture. To the maximum extent permitted by law, Apple has no other warranty obligation for Neurture.

Neurture, not Apple, is responsible for addressing claims relating to Neurture or your possession or use of Neurture, including product-liability claims, legal or regulatory claims, consumer-protection claims, privacy claims, and intellectual-property claims.

You represent and warrant that you are not located in a country subject to a US government embargo or designated by the US government as a terrorist-supporting country, and that you are not listed on any US government list of prohibited or restricted parties.

You must comply with applicable third-party terms when using Neurture. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as third-party beneficiaries.

17. Google Play Terms

This section applies when you download or use Neurture through Google Play. These Terms are between you and Neurture LLC, not Google. Google is not responsible for and has no liability under these Terms or any separate end-user license terms between you and Neurture.

Your download, purchase, subscription, refund, family sharing, device access, automatic updates, and use of Google Play are also governed by the Google Play Terms of Service and other applicable Google terms. If Google Play terms supersede a conflicting provision of these Terms for Google Play distribution, the Google Play terms control for that conflict.

Subject to these Terms and applicable Google Play terms, Neurture grants users who obtain Neurture through Google Play a non-exclusive license to use the app as permitted for personal, non-commercial use. Paid service features, subscriptions, gifts, partner entitlements, and server-side features may require active entitlement even if the app remains installed.

18. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules, except to the extent applicable consumer-protection or local law requires otherwise.

Before filing a claim, you and Neurture agree to try to resolve the issue informally by contacting support@neurtureapp.com. If the issue is not resolved informally, disputes will be brought in the state or federal courts located in Massachusetts, except where applicable law gives you the right to bring a claim elsewhere.

19. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the date at the top of this page and take any additional steps required by law. Your continued use of Neurture after updated Terms become effective means you accept the updated Terms.

If you do not agree to updated Terms, stop using Neurture and cancel any active subscription through the store or billing provider that manages it.
